2.2.17You or user — The person using the applicable AppWow or VESIRON service.
2.3 Acceptance of these Terms
2.3.1Public browsing and discovery through AppWow donot, merely by being available to a visitor, require the visitor to create an account or complete a contractual acceptance process.
2.3.2Where registration, membership, subscription, submission or another contractual facility expressly requires acceptance of these Terms, the person proceeding must positivelyconfirm that they have had the opportunity to read and agree to the Terms before completing that action.
2.3.3Where a participant is under 18 and Parent or Legal Guardian acceptance is required, the Parent or Legal Guardian must provide the required contractual acceptance and assumes the applicable contractual responsibility.
2.3.4VESIRON may record the account or user associated with an acceptance, the version of the Terms accepted and the date and time of acceptance so that the applicable contractual record can be identified.
2.4 Age, authority and young developers
2.4.1Public browsing of AppWow is not generally restricted to persons aged 18 or over.
2.4.2A person must be aged 18 or over to participateindependently in a service requiring registration, membership, submission or contractual acceptance.
2.4.3A person under 18 may participate where the relevant Parent or Legal Guardian provides the required consent and accepts the applicable contractual responsibility.
2.4.4The young person may still be identified as theactual developer or creator; parental or guardian involvement does not by itself transfer ownership of that person's work.
2.4.5Publications and external services may impose their own age or suitability restrictions, which remain applicable independently of access to AppWow.
2.5 VESIRON services and Independent Publications
2.5.1Where a service is supplied or operated by VESIRON, VESIRON remains responsible for its own obligations as required by applicable law.
2.5.2Where AppWow lists an Independent Publication, the independent developer or provider remains responsible for that Publication, its content, operation, availability, transactions and its own terms and privacy arrangements.
2.5.3Listing, assessment, verification, classification, ranking or display by AppWow does not by itself make VESIRON the owner, operator, host or supplier of an Independent Publication, nor amount to a continuing guarantee or general endorsement.
2.6 Verification and assessment
2.6.1A Verified Status always carries a descriptor identifying what has been verified and confirms only the defined criteria for that status at the relevant time.
2.6.2Different statuses are independent; verification of a Developer or Member does not automatically verify a Publication.
2.6.3Verified Member may reflect an established paidmembership relationship and the additional account or transaction audit trail arising from it. It is not full identity verification or KYC and is not a guarantee of identity, trustworthiness, conduct or performance. Users decide what weight to give that information.
2.6.4A complaint alone does not constitute a strike.
2.6.5A confirmed strike remains active for 12 months.
2.6.6A further confirmed strike while one is active extends the active period for a further 12 months from the date of the subsequent strike.
2.6.7Three active strikes result in withdrawal of Verified Member status.
2.6.8Serious fraud, security, unlawful activity or comparable material risk may justify immediate suspension or withdrawal pending review without waiting for three strikes.
2.6.9Detailed criteria and review or reinstatement procedures may be set out in a VESIRON Verification Framework or policy.
2.7 Listing, review, suspension and removal
2.7.1Listing is not a permanent entitlement. VESIRONmay review, restrict, suspend, reclassify or remove a Publication where it reasonably believes it no longer meets applicablerequirements, presents a security or safety concern, infringes rights, is unlawful or materially misleading, has materially changed since assessment, or presents a material risk to AppWow, users or the EVOSYSTEM.
2.7.2For ordinary compliance issues VESIRON will normally seek to provide notice and a reasonable opportunity to correct the issue.
2.7.3Immediate restriction or suspension may be usedfor malware, fraud, a compromised destination, unlawful material, impersonation or another serious or immediate concern.
2.7.4Membership does not guarantee acceptance, ranking, verification, Featured status or permanent listing.
2.7.5Removal of a Publication does not automaticallyterminate membership or an account.
2.8 Developer responsibilities
2.8.1A Developer confirms authority to submit and manage the Publication and to permit AppWow to display supplied names, descriptions, icons, screenshots and listing material.
2.8.2Information must be materially accurate and theDeveloper must have the rights necessary to use and provide submitted intellectual property.
2.8.3Developers remain responsible for Independent Publications and must not knowingly submit malware, fraudulent, unlawful or deceptive content or functionality.
2.8.4Developers must notify or update AppWow where amaterial change affects supplied information or the basis of an assessment, including material changes to functionality, ownership, destination, data handling, payment behaviour, age suitability or security.
2.8.5Developers must comply with applicable minimum-age and child-protection requirements and accurately declare relevant age restrictions or suitability.
2.9 Intellectual property and permission to display
2.9.1Developers retain ownership of their Publications and the branding, icons, screenshots, text and other intellectual property they own. Submission does not transfer ownership to VESIRON.
2.9.2By submitting listing material, the Developer grants VESIRON a non-exclusive, royalty-free permission to use, reproduce, format and display it as reasonably required to operate, present and promote the AppWow listing and enable discovery.
2.9.3This principally applies while listed, subject to reasonable continuation for legal, compliance and record-keeping purposes and material already legitimately produced.
2.9.4VESIRON retains its rights in AppWow, the EVOSYSTEM, technology, presentation, branding and proprietary material.
2.9.5Developers remain responsible for protecting and enforcing their own intellectual property against independent third parties.
2.9.6Where an allegedly infringing Publication is itself listed on AppWow, a rights holder may report it for investigation and possible restriction or removal.
2.10 Use of AppWow and VESIRON names, brands and identifiers
2.10.1AppWow, AppWow.app, The Global WebStore and the associated VESIRON, Linx, Lynx, Wapp and other VESIRON names, logos, branding and identifiers may be protected by intellectual-property, passing-off or other applicable rights.
2.10.2A third party may make truthful referential use of an applicable name where reasonably necessary to identify AppWow, a VESIRON service or the fact that a Publication is listed or available through AppWow, provided that use is not misleading and does not imply ownership, partnership, approval, sponsorship or endorsement that has not been granted.
2.10.3A third party must not adopt, reproduce, imitate or use VESIRON names, logos, branding or identifiers as its own branding, or in a way likely to create confusion about ownership, origin, affiliation or endorsement, without the required authority or consent.
2.10.4Where VESIRON gives permission for use of a name, logo, badge or other identifier, that permission is limited to the purpose, scope, duration and conditions for which it was given. Permission for one use does not create general permission for another.
2.10.5Nothing in these Terms represents that every name or identifier used within the EVOSYSTEM is a registered trade mark. VESIRON reserves the rights and remedies actually available to it in relation to its intellectual property, branding and goodwill.
2.11 Discovery, referrals and third-party transactions
2.11.1Discovery through AppWow, a Linx service or a VESIRON-operated Publication such as WappVert does not by itself make VESIRON a party to a subsequent purchase, sale, booking, engagement or other transaction with an independent seller or provider.
2.11.2Unless VESIRON is expressly identified as seller, supplier or contracting party, the underlying transaction is between the user and the identified independent provider.
2.11.3The independent provider remains responsible for its goods or services, payment arrangements, delivery, warranties, refunds and disputes subject to applicable law.
2.12 Discovery, rankings and featured placement
2.12.1AppWow may organise, categorise, rank, featureor promote Publications using its own discovery mechanisms.
2.12.2Inclusion, position, category, popularity or prominence does not itself constitute a recommendation, endorsement or guarantee of quality, suitability, reliability or commercial performance.
2.12.3AppWow does not use conventional Search EngineOptimisation (SEO) techniques or a Publication's external search-engine ranking as a basis for placement within organic AppWow discovery results.
2.12.4AppWow may use its own publication data, classifications, relevance criteria and discovery methodology.
2.12.5Featured by Selection and Featured by Sponsorship are separate concepts; sponsored prominence is commercial placement and will be identified as such.
2.13 Search results
2.13.1AppWow and Linx discovery services are not an exhaustive index of all websites, apps, Wapps, businesses, products, services or Publications.
2.13.2Results depend on available Publications, supplied information and metadata, the user's query and the applicable discovery methodology.
2.13.3Absence from a result does not mean a Publication does not exist, is unavailable elsewhere or has necessarily been rejected.
2.13.4VESIRON does not guarantee every search will identify every relevant Publication or the exact result intended.
2.14 Online, offline and HWA capability
2.14.1Whether a Publication works wholly or partly offline depends on its individual design, functionality and technical structure.
2.14.2Inclusion or classification within AppWow doesnot mean it is offline-capable, installable or universally compatible.
2.14.3HWA is VESIRON terminology for a Hybrid Web Application concept or classification.
2.14.4An HWA may combine web-based and mobile application-style characteristics, but the designation does not mean every HWA provides the same functionality or works on every device, operating system, browser or platform, or has offline working capabilities.
2.14.5Features may depend on permissions, connectivity, authentication, payments, synchronisation, live data, APIs, updates or device and browser capabilities.
2.15 Acceptable use
2.15.1Users must not use AppWow or an applicable EVOSYSTEM service for unlawful, fraudulent, deceptive or malicious activity; impersonation; materially false or misleading information; malware; unauthorised access; interference or attack; manipulation of ratings, reviews, popularity, verification, Featured status or discovery; intellectual-property misuse; or circumvention of account, Publication, suspension, strike or verification controls.
2.15.2AppWow does not tolerate discrimination, hatred or targeted abuse.
2.15.3Services must not be used to discriminate against, harass, threaten or demean individuals or groups, or to incite hatred or hostility toward them, on protected or other personal characteristics where contrary to law or applicable AppWow participation standards.
2.15.4VESIRON may also act against automated, bot orbulk activity, or other conduct, that materially compromises security, integrity, lawful operation or intended functioning.
2.16 Accounts, membership and service action
2.16.1An account, membership or subscription, Verified Status and Publication are separate matters. Action affecting one does not automatically affect all others.
2.16.2VESIRON may apply proportionate restrictions, suspension or termination for breach, security concerns, fraud, unlawful activity, serious misuse or repeated non-compliance.
2.16.3Ordinary issues will normally allow reasonablenotice and an opportunity to remedy or challenge.
2.16.4Urgent security, fraud, safety or serious legal concerns may require immediate action followed by review where appropriate.
2.16.5Voluntary cancellation is not disciplinary termination.
2.17 MyDash and DevLinx
2.17.1MyDash and DevLinx are authenticated administration and management environments.
2.17.2Access is for the account holder or another person properly authorised to act for the relevant user, Developer or business.
2.17.3Users must take reasonable steps to protect access credentials and should promptly notify VESIRON if they reasonably believe access has been compromised.
2.17.4Dashboard users must not access another person's or business's records without authority, misrepresent ownership or authority, evade a restriction, manipulate an assessment or verification process, or interfere with dashboard security or operation.
2.17.5Information must remain materially accurate where it affects the service.
2.17.6A business representative must have authority to act.
2.17.7A young Developer may remain identified as creator while the required Parent or Legal Guardian holds the applicable contractual responsibility.
2.18 Personal data is not for sale
2.18.1VESIRON does not sell, rent or trade users' ormembers' personal data, including names, email addresses and contact details, to third parties for those third parties' own marketing, advertising or commercial exploitation.
2.18.2Personal data may nevertheless be processed ordisclosed where reasonably necessary to operate a service, where the user authorises it, or where required or permitted by applicable law, court order, regulator or other legally valid authority.
2.18.3The Privacy Policy will describe applicable processing in greater detail.
2.19 Payments, subscriptions, cancellation and refunds
2.19.1For a paid service, the applicable price, billing frequency, introductory period and subsequent price will be presented before commitment.
2.19.2Recurring subscriptions may renew automatically where made clear.
2.19.3Unless specifically stated, payment processingis performed by a licensed independent payment provider.
2.19.4Cancelling a monthly or annual subscription stops future renewal.
2.19.5Subject to statutory rights and service-specific terms, the paid service ordinarily remains available until the end of the period already paid for and ordinary cancellation does not create a pro-rata refund for unused time.
2.19.6A refund, credit or other remedy may be appropriate where required by law or in circumstances such as a prolonged material service problem.
2.19.7A subscriber-initiated chargeback or payment reversal may result in immediate suspension of the affected paid service or entitlement while investigated, but does not by itself require termination of the entire account.
2.19.8Payment for membership or another service doesnot buy favourable assessment, organic ranking, Featured by Selection status, verification, acceptance or immunity from compliance action.
2.19.9Featured by Sponsorship purchases only the disclosed sponsored placement or benefit.
2.20 Service availability and external infrastructure
2.20.1VESIRON may develop, update, replace, add or withdraw features as the EVOSYSTEM develops.
2.20.2Services may require maintenance or experienceinterruption, and uninterrupted or error-free availability is not guaranteed.
2.20.3VESIRON-operated services may depend on third-party hosting, network, communications, authentication, payment and security infrastructure and can be affected by provider outages, network or routing disruption, DNS or power failures, cyberattack, distributed denial-of-service attack and other circumstances outside VESIRON's reasonable control.
2.20.4These provisions do not remove responsibility VESIRON has under applicable law, including obligations relating to reasonable care and skill.
2.20.5A prolonged material failure of a paid servicewill be addressed in light of the circumstances, applicable service terms and statutory rights.
2.21 Liability and statutory rights
2.21.1Nothing in these Terms excludes or restricts liability where it cannot lawfully be excluded or restricted, including liability for death or personal injury caused by negligence, or statutory rights and remedies applying to consumers.
2.21.2VESIRON is responsible for its own obligationsand conduct where required by applicable law.
2.21.3Subject to those obligations, VESIRON is not responsible merely because AppWow enabled discovery of an Independent Publication for the independent provider's content, operation, goods, services or subsequent transaction, or for independent third-party copying, redistribution or misuse of a Developer's material.
2.21.4Different provisions may apply where a person acts wholly or mainly for business purposes; any business-specific limitation will be stated in applicable service terms where required.
2.22 Changes to services and these Terms
2.22.1AppWow is developing and Beta services may evolve. VESIRON may make reasonable changes to services and these Terms to reflect development, legal or regulatory requirements, security, technical changes or changes to services offered.
2.22.2A Beta designation does not remove applicable legal obligations.
2.22.3Minor corrections, clarifications, formatting changes or administrative changes that do not materially alter the contractual relationship may be incorporated into a newly identified version without necessarily requiring fresh acceptance.
2.22.4Where a change materially affects rights, obligations, charges, an existing paid service or another continuing contractual relationship, VESIRON will provide appropriate notice and, where the nature of the change requires it, obtain fresh affirmative acceptance.
2.22.5A new version of these Terms does not retrospectively remove rights or remedies that have already arisen under applicable law or rewrite which Terms applied to a contractual relationship at an earlier time.
2.22.6Where a change materially affects a paid service or existing contractual commitment, it will be addressed reasonably and in accordance with applicable statutory rights.
2.23 Governing law
2.23.1These Terms are governed by the laws of England and Wales.
2.23.2If you are a consumer, this does not deprive you of mandatory protections applying under the law of the country in which you live, nor any right under applicable law to bring proceedings in a court available to you.

3.4 Information generated through use of AppWow
3.4.1AppWow may create or use a browser identifier to support service continuity and relevant functionality. The current AppWow Beta uses a first-party browser local-storage value identified as owner_id. It is not, by itself, a conventional browser cookie.
3.4.2AppWow may also store user-selected preferences locally on the user's browser or device, including homepage category selections.
3.4.3VESIRON-operated services and their infrastructure may generate or process technical information reasonably necessary for delivery, reliability, diagnostics, fraud prevention, abuse prevention and security.

3.6.2Depending on the circumstances, processing may be necessary to perform a contract with you or to take steps at your request before entering into a contract.
3.6.3Processing may also be necessary for VESIRON's legitimate interests or those of another person, provided those interests are not overridden by your rights and interests.
3.6.4We may process personal information where necessary to comply with a legal obligation.
3.6.5Where processing is based on consent, you may withdraw that consent. Withdrawal does not make processing carried out before withdrawal unlawful.

3.7.2Developer or business information may be associated with submitted or published material, assessment records, service status and administrative records where necessary for the relevant service.

3.7.4Private account or administrative information does not become public merely because a Publication or business is listed through AppWow.
3.8 Young Developers and children
3.8.1Public discovery through AppWow is not generally restricted to adults merely because a visitor is under 18.
3.8.2Where a young person participates in a service involving registration, membership, submission or another contractual facility, the age and Parent or Legal Guardian provisions in the AppWow Terms & Conditions apply.
3.8.3Information relating to a Parent or Legal Guardian may be processed where necessary for consent, authority, communication, administration or the applicable contractual relationship.

3.9.3Unless expressly stated otherwise, VESIRON doesnot require users to provide payment-card credentials directly to AppWow for storage by AppWow.
3.9.4A Payment Service Provider may process payment and related information in accordance with its own privacy policy and legal responsibilities, depending upon its role in the relevant processing activity. References in this Policy to a Payment Service Provider do not imply that the provider necessarily acts solely as a data processor on VESIRON's behalf.

3.10.1VESIRON may use service providers for infrastructure, hosting, authentication, communications, payment, security, storage and other technical or operational services.

3.11.2When you leave a VESIRON-operated service to use an Independent Publication or external service, its operator may process personal information under its own privacy terms and practices.
3.11.3Listing, assessing, displaying or linking to an Independent Publication does not by itself make VESIRON the controller of personal information independently processed by that Publication's operator.
